ECS Consult provides strategic advisory services for transport and logistics, including (without limitation) rail (passenger and freight), mining logistics, port expansion, infrastructure concessions, and M&A support. If you provide suggestions, ideas, or other feedback, you grant ECS Consult a nonexclusive, transferable, sublicensable, worldwide, royalty-free license to use, copy, modify, and exploit the feedback for any purpose.

We treat client non‑public information confidentially in accordance with our contractual obligations. Any case studies or testimonials published on the Site have been shared with permission where required and may be anonymized or aggregated. Publication of such materials does not waive any confidentiality undertakings.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECS CONSULT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF THE SITE. OUR AGGREGATE LIABILITY FOR ANY CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

9. Indemnification

You agree to defend, indemnify, and hold harmless ECS Consult and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site.

10. Governing law and venue

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict‑of‑laws principles. Subject to Section 11 (Dispute Resolution), exclusive jurisdiction and venue for any action arising out of or relating to these Terms or the Site will be the state and federal courts located in Florida, and you consent to personal jurisdiction there.

11. Dispute resolution; arbitration (optional)

At our election, any dispute arising from or relating to these Terms or the Site shall be resolved by binding arbitration administered by a reputable arbitration provider under its rules. You and we waive any right to a jury trial. Either party may seek injunctive or equitable relief in court to prevent actual or threatened infringement or misappropriation of intellectual property or confidential information.

12. Changes to the Site or Terms

We may update the Site and these Terms from time to time. Changes take effect when posted. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

13. Termination

We may suspend or terminate your access to the Site at any time and for any reason without notice. Sections that by their nature should survive termination will survive (including, without limitation, Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law).
